With climate treaties taking the form of non-binding soft law and criminal law unable to target the majority of environmental harm, a new approach needs to be found to tackle the climate emergency. This project, therefore, looks at how human rights treaties could be used to implement soft law and mitigate climate change. The aim is to explore how different concepts of using a human rights based approach have and could be used. In the implementation phase of the project, these findings are applied to a fictional case concerning four young people from Germany. The application of this case, LEE and Others v. The State of Germany, constitutes the final outcome of this project.
